Everstrike is a platform owned and operated by Everstrike Labs. The exchange is available at everstrike.io. A testnet version is available at testnet.everstrike.io.
Section 1 — Applicable Laws and Regulations
Your use of the exchange is subject to all applicable laws, regulations, and rules of any governmental or regulatory authority, including tax, anti-money laundering (AML), and counter-terrorist financing (CTF) provisions. If your country of residence is within the European Economic Area (EEA), Everstrike acts as your GDPR representative for the purposes of Regulation (EU) 2016/679. By creating an account, you acknowledge that you will comply with these Terms and all applicable laws at all times. Failure to comply may result in suspension or termination of your account.Section 2 — Eligibility
You represent and warrant that you:- Are of legal age to form a binding contract in your jurisdiction
- Have not previously been suspended or removed from using Everstrike’s services
- Have full power and authority to enter into this agreement without violating any other agreement you are party to
Section 3 — AML and CTF Compliance
Everstrike’s AML and CTF procedures comply with all applicable rules and regulations. Everstrike takes all necessary steps to prohibit fraudulent transactions, report suspicious activities, and prevent money laundering, terrorist financing, and related financial crimes.Section 4 — Account Registration
When you sign up, you must provide complete, accurate, and up-to-date information. You may not share your account credentials with any other person. You are the sole authorized user of your account. You agree to provide additional identity verification information (the “Information”) when requested, including government-issued ID and proof of residence. You grant Everstrike permission to retain this information and to make any inquiries — directly or through third parties — necessary to protect against fraud or financial crime.Section 5 — Digital Asset Transactions
To begin trading, you must first fund your account with supported digital assets. Everstrike does not support fiat currency deposits. After signing up, Everstrike provides you with a deposit address for each supported digital asset. Important rules for deposits and withdrawals:- Always send a digital asset only to the deposit address Everstrike provided for that exact asset.
- Sending a digital asset to an incorrect address — including an address not associated with your account or not associated with that specific asset — may result in permanent loss of funds.
- Everstrike is not responsible for losses caused by incorrect address submissions.
- Everstrike does not support direct deposits from smart contracts. Funds sent directly from smart contracts must be credited manually — contact Everstrike support if this applies to you.
Section 6 — Digital Asset Trading
Transactions on Everstrike may fail for reasons including insufficient margin, technical problems, or price changes. Everstrike makes no guarantee that every transaction will execute without failure and bears no liability for failed or delayed transactions. Everstrike reserves the right to cancel, refuse, or reverse any trade or transaction, or impose trading restrictions (including price limits and size limits), at any time without prior notice. You agree that Everstrike’s calculations associated with operating the exchange — including P&L of open positions, collateral calculation, average entry price, position liquidation, position swap, and position deleverage — are binding and final.Section 7 — Digital Asset Derivatives
Everstrike offers perpetual derivatives contracts with no fixed expiration. Trading derivatives is considered high risk. To open a derivatives position, you must deposit collateral. Subject to market conditions, your position may be liquidated and you may lose your entire deposited collateral. Derivatives positions are highly leveraged and may represent a much greater value than your deposited collateral. Liquidation order:- Everstrike may cancel your open orders and/or liquidate your positions (Position Liquidation) if your collateral falls below the collateral requirement.
- If Everstrike cannot liquidate positions due to insufficient market demand, it may assign your positions to another user (Position Assignment).
- If assignment is not possible, Everstrike may deleverage your positions (Position Deleverage), ending the contracts at the deleverage price.
Section 8 — Digital Asset Pricing Information
While Everstrike uses commercially reasonable methodology to provide exchange rate information, rates may differ from those provided by third parties. The market rate at which your trade executes may differ from the indicated rate on the exchange. Everstrike bears no liability for losses related to price fluctuations or rate discrepancies.Section 9 — Digital Asset Distributions
Everstrike generally does not support distributions based on asset possession, protocol rewards, or dividends. Everstrike may at its sole discretion choose to support a particular distribution but bears no liability for failing to do so.Section 10 — Digital Asset Forks
Everstrike is under no obligation to support any fork of a digital asset you hold. Forks can be frequent and unpredictable. When trading on Everstrike, operate under the assumption that Everstrike will not support any fork. Everstrike may announce support for specific forks at its sole discretion. In the event of a fork, Everstrike may suspend all related activities including deposits, withdrawals, and trading. Everstrike bears no liability for losses during any resulting downtime.Section 11 — Digital Asset Ownership
You represent and warrant that any digital assets you use on Everstrike are either your own or that you are rightfully authorized to transact with them. You further represent that all transactions from your account are for your own account, not on behalf of any third party.Section 12 — Unentitled Data
If you receive data or software through the services that you are not entitled to receive, you may not use it and must notify Everstrike immediately.Section 13 — Service Availability
Everstrike will make reasonable efforts to keep the services available. Access may be disrupted due to technical issues, maintenance, or events outside Everstrike’s control. Everstrike assumes no liability for trading-related losses arising from service unavailability.Section 14 — Service Malfunctions
Notify Everstrike immediately if you become aware of any service malfunction, trading error, or connectivity problem that adversely affects your access to the services.Section 15 — Blockchain Network Attacks
Everstrike cannot prevent or mitigate attacks on blockchain networks. In the event of a confirmed attack on a listed digital asset, Everstrike may immediately halt trading, deposits, and withdrawals for that asset, and may discontinue trading entirely if the asset has greatly decreased in value. Everstrike bears no liability for losses incurred during any resulting downtime.Section 16 — Confidential Information
You agree not to disclose any confidential information you acquire through your use of the exchange. Confidential information means any trade secret, confidential, or proprietary information that is clearly identified as confidential or would be reasonably assumed to be confidential under the circumstances.Section 17 — Development Services
Certain services, including beta software, may be unstable and subject to change. Everstrike does not warrant that development services will meet your requirements or operate without interruption. Everstrike reserves the right to discontinue, modify, or enhance any service at any time.Section 18 — Testnet Site
The testnet is provided for informational and testing purposes only. While the testnet uses the same market data and indices as the main site, there may be discrepancies. Past performance on the testnet is not a reliable indicator of future results on the main site.Section 19 — API Usage
Subject to your compliance with this agreement, Everstrike grants you a limited, revocable, non-transferable, non-exclusive, non-sublicensable license to use the API solely for trading on Everstrike. You use the API entirely at your own risk. Everstrike may set and enforce rate limits on API calls and may suspend or terminate your API access immediately if you violate these Terms.Section 20 — Account Suspension
Everstrike may, in its sole discretion, suspend, refuse to create, or terminate your account for reasons including failure to verify your identity, account inactivity, a court order, or violation of these Terms. You may close your account at any time by contacting Everstrike.Section 35 — Intellectual Property
All intellectual property rights relating to the exchange, its materials, design, layout, graphical images, and underlying source code belong to Everstrike. You may use the services only for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or commercially use any part of the exchange without Everstrike’s prior written consent.Section 32 — Restricted Territories
The services are not offered to persons or entities residing in the United States of America, Canada, Bosnia and Herzegovina, Romania, the Republic of the Seychelles, or any other Restricted Territory. It is your responsibility to ensure that you are not a resident of a Restricted Territory. See the full list on the Restricted Jurisdictions page.Section 33 — Restricted Activities
You must not:- Provide false, inaccurate, incomplete, or misleading information
- Engage in money laundering, fraud, terrorist financing, or any other illegal activity
- Violate any applicable law, statute, or regulation
- Distribute spam, unsolicited advertising, or unauthorized promotional material
- Infringe Everstrike’s or any third party’s intellectual property rights
- Attempt unauthorized access to other accounts, the site, or related networks
- Transmit viruses, worms, or other malicious software
- Use web crawlers or similar tools to scrape the services
- Reverse engineer any part of the site, API, or services
- Engage in market abuse including front-running, wash trading, or fictitious transactions
- Use the services on behalf of any third party or act as an intermediary
Section 34 — Risk Disclosure
By trading on the exchange, you can lose up to your entire deposit. Do not deposit digital assets you cannot afford to lose. Seek advice from an independent, suitably licensed financial advisor before trading. Specific risks include:- Market risk — digital asset prices are highly volatile and positions can move against you
- Credit risk — counterparties may have insufficient collateral to cover what they owe
- Liquidity risk — you may be unable to close a position due to lack of market demand
- Operational risk — exchange malfunctions, downtime, or system failures may cause losses
- Regulatory risk — regulatory action may require Everstrike to restrict or terminate services
Section 36 — Indemnification
You agree to indemnify and hold Everstrike, its affiliates, service providers, shareholders, directors, officers, employees, attorneys, agents, representatives, suppliers, and contractors harmless from any claim arising from your breach of these Terms, your violation of any law, or your use of the services.Section 37 — Limitation of Liability
To the maximum extent permitted by law, Everstrike and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of profits, goodwill, use, or data — arising from your use or inability to use the services. Everstrike’s total liability arising out of or in connection with the services will not exceed the fees you paid to Everstrike in the twelve months immediately preceding the event giving rise to the claim.Section 38 — No Warranty
The services are provided on an “as is” and “as available” basis. Everstrike expressly disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.Section 39 — Force Majeure
Everstrike bears no liability for failures or delays caused by events beyond its reasonable control, including flood, earthquake, fire, war, riot, labor dispute, government action, communications or power failure, or software or equipment malfunction.Section 40 — Governing Law
These Terms are governed by and construed in accordance with English law. The courts of the Republic of Seychelles have non-exclusive jurisdiction to settle any dispute arising from or connected with these Terms.Section 41 — Assignment
You may not assign or transfer any rights or obligations under these Terms without Everstrike’s prior written consent. Everstrike may assign any or all of its rights without your consent. If you object to such an assignment, you may close your account by contacting Everstrike.Section 42 — Amendments
Everstrike may amend these Terms at any time by posting a revised version. Changes take effect the first time you use the services after the posting date. If you do not agree with any amendment, your sole remedy is to stop using the services and close your account.Section 46 — Dispute Resolution
